 Overview

Nationally known for his expertise in real estate property matters, Brett Tkatch numbers Canada’s top commercial and residential development companies and commercial institutional lenders among his clients. He is a partner in Blaney McMurtry LLP, practising in the firm's real estate group and is the Head of the Real Estate Practice Group.

"I take great pride in knowing some of the people looking at my biography no doubt have visited some of the major development sites I have had the opportunity to be involved in," says Brett. Throughout his career, which began in 1988, Brett has been involved in a number of significant commercial real estate transactions acting for purchasers, vendors, lenders, landlords, tenants, municipalities and builders in all types of real estate projects. He has negotiated and drafted agreements of purchase and sale, encroachment agreements, joint venture agreements, co-ownership agreements, cost sharing agreements, easement agreements, restrictive covenant agreements, major land ground leases, credit agreements and interlender agreements.

The transactions in which he’s involved are nation-wide and at times involve international transactions across North America. He has been responsible for retaining counsel in other provinces on behalf of clients and overseeing key negotiations on major real estate transactions across Canada. From a lending standpoint he is involved in major portfolio loan purchases, participating loans amongst major lending institutions covering such properties as multi-million dollar office towers, residential portfolios, condominium developments and shopping centres. He also for many years sat on the First Canadian Title Round Table which deals with issues regarding commercial title insurance in Ontario and the issuance of title insurance policies.

Brett's practice also includes assisting LawPro with respect to solicitor's negligence claims in the real estate area and assessing if claims brought are with merit and assists litigation counsel on these.

During is spare time he likes to get away to the gym to work out, play squash and golf and spend a lot of time with his family and grandchildren.
