 Overview

When police and other first responders are in trouble, they turn to Eugene Mazzuca. For more than 15 years, Eugene has been the first contact for provincial and municipal entities and their insurers accused of false arrest, excessive force, malicious prosecution, negligent investigation, defamation, personal injury, property damage and other serious torts. He also handles claims against security guards as well as roads liability cases and unusual and novel claims for municipal and provincial bodies.

Eugene has defended hundreds of claims against government entities including the Ontario Provincial Police, the Peel, Niagara, York and Durham Regional Police, and the Ontario Ministry of Transportation, Natural Resources, Health, Environment and Public Safety.

  • Lead responding counsel before the Supreme Court of Canada on behalf of Niagara Police on the application of estoppel to a civil claim by a public complaints hearing

  • Obtained dismissal of false arrest and imprisonment case against Peel Police in a 2 week jury trial involving domestic violence

  • Obtained dismissal of negligent investigation and malicious prosecution case against Peel Police following a 2 week judge alone trial involving related criminal and family law proceedings

  • Obtained dismissal of false arrest and excessive force case against Peel Police in a 2 week jury trial involving courthouse security procedures post-9/11

  • Obtained dismissal of malicious prosecution claim against the O.P.P. at the outset of trial following a pre-trial motion seeking dismissal

  • Lead counsel in obtaining dismissal of conspiracy claims brought by multiple adult entertainment parlours alleging that a large joint police forces and Ontario Alcohol and Gaming Commission operation was designed to put them out of business

  • Successfully defended a majority of roads liability claims with no payouts

  • Defended paramedics against whom allegations of racial bias were made by a First Nations family who lost their son from traumatic injuries suffered in a motor vehicle accident at a high-profile St. Catharines Coroner’s inquest

  • Successful as respondent at the Ontario Court of Appeal in keeping Mexican co-defendant within Ontario’s jurisdiction on bus accident that occurred in Mexico

  • On appeal to the Ontario Court of Appeal, successfully enforced a U.K. judgment in Ontario in one of the first cases in the province involving the enforcement of a foreign default judgment.
