 Overview

Lea Nebel is a partner in the firm’s Commercial Litigation group and Co-Chair of the firm’s Construction Law group.

Lea represents a wide variety of clients in the construction industry, including owners, general contractors, subcontractors, material suppliers, design and engineering professionals, and sureties.

Her construction litigation related experience includes contract claims and disputes, construction liens, trust claims, lien priority disputes, surety bond claims, professional negligence, and bankruptcy. She also assists clients with drafting and negotiating construction agreements. Lea has represented clients on various projects including, residential; retail; transit expansion, airports; hospitality and gaming; athletic facilities; retirement homes; and recycling facilities.

Lea has appeared before all levels of court in Ontario and is a skilled litigator and trusted advocate. She is recognized by Best Lawyers® in Canada for her skill in Construction Law and the Lexpert® Canadian Legal Directory as a repeatedly recommended lawyer in Construction Law.

Lea is also experienced in partnership, shareholder and real estate disputes, mortgage enforcement, and defending clients against charges under the Ontario Provincial Offences Act.

  • Resolved claims by Tarion against a Builder and Vendor concerning deficiencies in the common elements of a condominium project.

  • Represented Sureties in prosecuting construction bond indemnity claims against Principals and Guarantors

  • Represented a not-for-profit registered charitable organization in negotiating/drafting a construction management agreement for the construction of a new senior centre.

  • Represented the largest manufacturer of fabricated pools worldwide in negotiating/drafting a contract for the construction of a new production facility in Canada.

  • Construction counsel to a Canadian company on its purchase of a plumbing, mechanical and electrical contractor.

  • Successfully defended one of Canada’s largest real estate investment trusts charged with violations of the Fire Protection and Prevention Act, 1997
